How cleared is your sample ?
Music copyright, licensing & Sample clearance, has been always confusing subjects, so we decided to dig a little bit on this and share our findings with you.
What exactly is a Music Copyright? Think of a copyright as a bundle of exclusive rights. The exclusivity means that only you as the copyright owner may exercise those rights in your music, or authorize others to exercise them.
Music licensing is the licensed use of copyrighted music. Music licensing is intended to ensure that the owners of copyrights on musical works are compensated for certain uses of their work. A purchaser has limited rights to use and reproduce the recorded work without a separately arranged agreement.
licensor is the owner of the licensed work and licensee is the person or entity to whom the work is licensed.
In music, Sampling is the act of taking a portion, or sample, of one sound recording and reusing it as an instrument or a sound recording in a different song or piece.
Everyone has heard the myths on sampling:
“I sampled only 4 bars, or 8 bars!
I changed the sample by using FX so I am good to go!
If I don’t sell enough copies or make any money, the record company or publisher won’t come after me, right?
